The Judge Files: It’s not sex genital piercing, it’s rape

[WARNINGS, sexual assault of children]

From the Shitty Things Judges Say files, we have this case from Melbourne: news.com.au “Genital piercers avoid jail for sex assault”.

Two tattoo artists from Tattoo City, Mark Andrew Ford (50) and Gregory Alan Ford (53) were involved in doing genital piercings on girls age 13 and 15. The rapist told the girls that he had to “stimulate the genital area for several minutes” before doing the piercings.

Putting aside for a moment the fact that it’s obviously illegal to perform genital piercings on children:

Judge Wendy Wilmoth lectured them it was a “very serious offence”, but then dropped this clanger:

“In this unusual case, the penetration of each child was carried out at the child’s request, and in pursuit of something which might be called a fashion or a fad.”

Unfortunately this is not even slightly an unusual case, Wilmoth. Rapists sexually assault children all the time in the course of things that they’ve convinced the children they “requested”, or in the course of what might otherwise be normal care.

If a child asks a carer to wipe their bum, and the carer sexually assaults them, was that “carried out at the child’s request”? If a child goes to a doctor for a physical examination and the doctor sexually assaults them, was that “carried out at the child’s request”? If a child asks a teacher to look at an injury and the teacher sexually assaults them, was that “carried out at the child’s request”?

So what’s difference about genital piercings, huh? I think I can guess. Only Sluttery McSluttersons want those, eh Judge?

No. These girls requested genital piercings. What they got was lies and sexual assault. This is business as usual in the rape world, and does not call for any mitigation.

She sentenced the men to two years and six months in prison, wholly suspended for three years.

Is that a mild slapping noise I hear in the distance?

Update: It gets worse. NineMSN has more details:

Judge Wilmoth noted the Fords’ business Tattoo City no longer performed intimate piercings, regardless of the age of the customer.

She said Gregory Ford’s wife had been dying at the time of the 2007 incident.

Judge Wilmoth said despite the assaults, the girls had been treated professionally and in a clinical manner.

Holy fuck.

  1. I was disgusted that it wasn’t called rape, disgusted at the sentence, and disgusted that somehow these two children have become convinced that they needed these piercings. I can’t put my feelings about the rapists into polite words so I won’t.

  2. Wow. First off, I’m having a very difficult time getting my brain around the idea that a reputable piercer would even perform a genital piercing on anyone under 17 or 18. Oh wait…a reputable piercer most likely wouldn’t, although I wish I could say that inappropriate touching were uncommon during genital piercing generally, even by people with otherwise stellar reputations.
I’m also surprised that the law would permit it (but that may be my puritan USian talking). By which I mean, non-ear piercing if anything that young without parental permission.
Argh. Just enraging all around and shame on that judge for making excuses for these scumbags.

  3. How easy it is to dismiss assault as something else. This is disgusting and nothing “clinical” occured there. How could anyone let alone a child consent to assault. The asshattery of some people is astounding.

  4. You know me. I heard about this and NACEY SMASH! I was incoherent with rage again when I was about to post but then that awesome Kath n’ Kim graphic popped up and made me smile. Thank you!

  5. OFFS.
Just. Ugh. I just, ugh, they were probably taking advantage of the children – how can anybody not see that?! And seriously?! People BUY this “he needed to stimulate the genital area” bullshit?! AUGH! Talk about denial!

    Oh, well that’s okay then.
Jesus H Christ on a raft.

I get the strong impression that if these girls has been of age, the Judge wouldn’t have seen a thing wrong with what went on.

  8. Methinks its another example of female misogyny [by this I mean misogyny perpetrated by a woman] –
heres another tasty lil morsel from *the same judge*:

Apparently only women who have ‘made it in a mans world’ like she has deserve any kind of real recompense.
